Terms of Service

1. Introduction

Welcome to Seahart ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Seahart application, website, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Service.

2. Service Description

Seahart is an iOS-exclusive social app that enables users to share their status pictures and status updates through interactive home screen widgets. The app focuses on creating intimate social pods where users can stay connected with close friends and family through simple, widget-based interactions.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the right, authority, and capacity to enter into these Terms.

4. Account Registration

To use certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. User Content

The Service allows you to post, share, and store content, including text, images, and videos ("User Content"). You retain all rights in, and are solely responsible for, the User Content you post to the Service.

By posting User Content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your User Content for the purpose of operating and providing the Service.

You represent and warrant that:

  • You own the User Content posted by you on or through the Service or otherwise have the right to grant the rights and licenses set forth in these Terms;
  • The posting and use of your User Content on or through the Service does not violate, misappropriate, or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademark, and/or other intellectual property rights;
  • Your User Content does not violate any applicable law or regulation; and
  • Your User Content does not contain any material that solicits personal information from anyone under 18 or exploit people under 18 in a sexual or violent manner.

6. Pod Management

The Service allows you to create and join social pods. As a pod creator or member, you agree to the following:

  • You are responsible for managing your pod's invite code. Everyone can join your pod if your pod invite code is public/unlocked. You are fully responsible if any stranger somehow joins your pod.
  • We recommend locking your pod as soon as everyone of your friends has joined. If someone new needs to join, unlock the code temporarily, ask them to join, and lock it again.
  • You can leave a pod at any time, except if you are the creator of the pod or the active PRO sponsor of that pod.
  • You can remove other members inside the pods you are in, except the pod creator and yourself.
  • You can change your pod name.

7. PRO Features

The Service offers PRO features that are available through subscription or pod sponsorship:

  • To access PRO widgets, you need to join at least one PRO pod/group.
  • All members can participate to sponsor/upgrade their pod if the pod doesn't have PRO status attached.
  • PRO members can enjoy many extra benefits like premium home widgets and bigger groups, among other features.

Subscription fees are non-refundable except as required by law. We reserve the right to change subscription fees upon reasonable notice.

8. Consent to Share Consumption Data with Apple

By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. We ensure that such data sharing is done in compliance with Apple's policies and only as necessary to process your requests.

9. Content Retention

Media content (images/videos) shared through the Service is stored for only 42 hours, after which it will be automatically deleted from our servers.

Text status updates will be stored in our database as we plan to implement a feature allowing users to view their past status updates.

10. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Using the Service for any illegal purpose or in violation of any local, state, national, or international law;
  • Harassing, threatening, intimidating, or stalking any other users of the Service;
  • Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity;
  • Interfering with or disrupting the Service or servers or networks connected to the Service;
  • Attempting to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service;
  • Using any robot, spider, crawler, scraper, or other automated means to access the Service or collect content for any purpose;
  • Posting content that contains nudity, violence, or offensive subject matter;
  • Infringing the intellectual property rights, privacy rights, or any other rights of any person or entity;
  • Submitting false or misleading information.

11. Termination

We reserve the right to suspend or terminate your access to the Service, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

You can request to delete your account via the app. Once your account is deleted, you won't be able to log in anymore, and your data will be deleted in accordance with our data retention policies.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS, OR BE ACCURATE, RELIABLE, COMPLETE, LEGAL, OR SAFE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

IN NO EVENT WILL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE DATE OF THE ACTIVITY GIVING RISE TO THE LIABILITY.

14. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes to these Terms, we will provide notice of such changes, such as by sending an email, providing a notice through the Service, or updating the "Last Updated" date at the top of these Terms. Your continued use of the Service following the posting of updated Terms will mean that you accept and agree to the changes.
